Website Project Terms

These terms (“Project Terms”) apply to PeakSpire website design and development projects, including the Lead-Gen Website service. They supplement the Master Services Agreement. In the event of a conflict, these terms take precedence for website projects.

1. Project Phases

Website projects follow these phases:

1. Discovery: We review your business, goals, competition, and requirements. A project brief is created and approved by you before design begins.
2. Design: We create the visual design for your website. You review the design and provide feedback.
3. Development: We build the approved design into a functional WordPress website.
4. Content: Final content is placed into the website. Content responsibility is defined in the SOW.
5. Review: You review the completed website on a staging environment and submit feedback.
6. Launch: After your written approval, we deploy the website to its live domain.

2. Approvals

• You approve the design before development begins. Changes to the approved design after development starts may incur additional charges.
• You approve the completed website before launch. We will not launch a website without your written approval (email confirmation is sufficient).
• Approval requests are sent via email. If you do not respond within 7 business days, a follow-up is sent. If there is no response within 14 business days of the original request, the deliverable is considered approved.

3. Revisions

• Design revisions: The project includes up to 2 rounds of design revisions unless otherwise specified in the SOW.
• Development revisions: Feedback during the Review phase is included. Requests to change previously approved design elements are considered additional scope.
• Additional revisions: Beyond the included rounds, revisions are billed at $150 CAD/hour, with time confirmed before work begins.

A “revision” is a set of changes submitted together. Each submission counts as one round, regardless of how many individual changes are included.

4. Timeline

• Estimated timelines are provided in the SOW. Timelines begin when the deposit is received and the project brief is approved.
• Timelines are estimates, not guarantees. Factors that may affect the timeline include scope changes, Client delays in providing content or feedback, and unforeseen technical challenges.
• If the Client’s delays extend the project timeline by more than 30 days beyond the original estimate, PeakSpire may adjust the project scope or pricing.

5. Content

5.1 Client-Provided Content

If the SOW specifies that the Client provides content, the Client must deliver all text, images, and media in an editable format (Google Doc, Word, or plain text) before the Content phase begins.

5.2 PeakSpire-Written Content

If the SOW includes content writing by PeakSpire, we will create content based on information gathered during Discovery. The Client reviews and approves all content before it goes live.

5.3 Content Responsibility

The Client is responsible for the accuracy and legality of all content on their website, whether provided by the Client or written by PeakSpire and approved by the Client.

6. Hosting and Domain

• PeakSpire builds websites on WordPress. Hosting is the Client’s responsibility unless the SOW includes hosting setup.
• If PeakSpire recommends or provisions hosting, the hosting account belongs to the Client. Login credentials are provided to the Client upon setup.
• Domain registration and renewal are the Client’s responsibility. PeakSpire can assist with DNS configuration as part of the launch process.

7. Launch

• Launch occurs after the Client provides written approval of the completed website.
• PeakSpire handles the technical deployment (DNS, SSL, performance optimization, testing).
• The Client is responsible for redirecting old URLs if migrating from an existing site (PeakSpire can assist with redirect mapping as part of the project scope).

8. Post-Launch Support

• The project includes 14 days of post-launch support for bug fixes and minor adjustments related to the delivered project.
• Post-launch support does not include new features, new pages, or changes outside the original project scope.
• After the 14-day support period, ongoing maintenance is available through the Care Plan ($199/month) or billed at $150 CAD/hour.

9. Cancellation

• The deposit is non-refundable.
• If the Client cancels before Development begins, the Client pays only the deposit.
• If the Client cancels during or after Development, the Client pays for all work completed at the hourly rate of $150/hour, minus the deposit already paid.
• If PeakSpire cancels, the Client receives a full refund of all payments made, and all completed work is delivered to the Client.

10. Ownership Upon Cancellation

• If the project is cancelled after the Client has paid for completed work, the Client owns the deliverables produced up to that point.
• PeakSpire retains its proprietary tools, frameworks, and reusable code as described in the Master Services Agreement.
