PeakSpire Inc. (“PeakSpire,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at peakspire.ca, use our services, or interact with us by phone, email, or chat.

  • Free Website Audit tool: Your name, email address, and the website URL you submit for analysis.
  • Phone calls: Your phone number (caller ID), name, email address, and any other information you share during the call. All calls are recorded (see Section 4).
  • Booking requests: Name, email address, phone number, and preferred meeting time when you schedule a discovery call.
  • Email correspondence: Any information you include in emails sent to us.

1.2 Information Collected Automatically

  • Website analytics: Pages visited, time spent, referral source, device type, browser type, and general geographic location (city level). Collected via Google Analytics 4.
  • Cookies: See our Cookie Policy for details on specific cookies used.
  • Conversion tracking: We use the Meta (Facebook) Pixel to measure the effectiveness of our advertising. This tracks page views and specific actions like form submissions.

1.3 Information Generated Through Our Services

  • Call recordings and transcripts: Phone calls handled by our AI voice assistant (Summit) are recorded and transcribed.
  • PageSpeed audit results: When you use our Free Website Audit tool, we generate a performance report for the URL you submitted using the Google PageSpeed Insights API.
  • AI interaction data: Conversations with our AI voice assistant are processed in real time and stored as call logs.

2. How We Use Your Information

We use your personal information for the following purposes:

  • Service delivery: To respond to your inquiries, schedule meetings, deliver website design, development, speed optimization, and SEO services.
  • Communication: To send you service confirmations, audit results, project updates, and respond to your questions.
  • Quality assurance: To review call recordings for training, accuracy, and service improvement.
  • Marketing (with consent): To send occasional emails about our services, industry insights, or special offers. You can unsubscribe at any time.
  • Analytics: To understand how visitors use our website and improve the user experience.
  • Legal compliance: To comply with applicable laws and regulations.

4. Call Recording

All inbound phone calls to PeakSpire are recorded. When you call us, our AI voice assistant provides a verbal notice that the call may be recorded before the conversation begins. Recordings are used for:

  • Ensuring accuracy of information exchanged during calls
  • Quality assurance and training
  • Maintaining a record of service requests and commitments

Call recordings are stored securely and retained for up to 12 months, after which they are deleted. You may request deletion of your call recording at any time by contacting us at info@peakspire.ca.

5. AI and Automated Processing

PeakSpire uses artificial intelligence in the following ways:

  • Summit (AI Voice Assistant): Our phone system uses OpenAI’s technology to have real-time conversations with callers. Summit can answer questions about our services, check appointment availability, and book meetings. All conversations are processed by OpenAI’s servers in the United States.
  • Call transcription: Recorded calls are transcribed using OpenAI’s Whisper service to create searchable text records.
  • Content assistance: Some website content and marketing materials are created with AI assistance, then reviewed and approved by our team.

No automated decisions with legal or significant effects are made about you based solely on AI processing. A human reviews all AI-generated outputs before they are acted upon.

6. Cross-Border Data Transfers

Several of our service providers are based in the United States. When your personal information is transferred outside of Canada, it becomes subject to the laws of that jurisdiction. We ensure that all transfers comply with PIPEDA requirements and that our service providers maintain comparable privacy protections.

Countries where your data may be processed include:

  • United States: Google, Meta, HubSpot, OpenAI, Telnyx, Cal.com, Stripe
  • European Union: Brevo (email delivery)
  • France: WP Rocket (website caching)

7. Data Retention

We retain your personal information only for as long as necessary to fulfil the purposes described in this policy:

  • Contact form submissions and leads: Retained for 24 months from the date of submission, then deleted.
  • Call recordings: Retained for up to 12 months, then deleted.
  • Call transcripts: Retained for up to 12 months, then deleted.
  • Website analytics data: Google Analytics retains data for 14 months (our configured retention period).
  • Email marketing contacts: Retained until you unsubscribe.
  • Client project files: Retained for the duration of the client relationship plus 24 months.
  • Accounting and billing records: Retained for 7 years as required by Canadian tax law.

8. Your Rights Under PIPEDA

As a Canadian resident, you have the following rights regarding your personal information:

  • Right to access: You may request a copy of the personal information we hold about you.
  • Right to correction: You may request that we correct inaccurate or incomplete information.
  • Right to deletion: You may request that we delete your personal information, subject to legal retention requirements.
  • Right to withdraw consent: You may withdraw your consent for specific uses of your information at any time.
  • Right to complain: If you believe your privacy rights have been violated, you may file a complaint with the Office of the Privacy Commissioner of Canada.

  • Phone calls: A verbal recording notice is provided at the start of every call. By continuing the call, you consent to the recording.
  • Cookies: A cookie consent banner is displayed on your first visit. You may accept or decline non-essential cookies.
  • Marketing emails: We send marketing emails only with your express consent (opt-in). You can unsubscribe at any time using the link in every email.

10. Security

We take reasonable measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include:

  • SSL/TLS encryption on all website communications
  • Secure SSH access to our hosting environment
  • API keys and credentials stored in environment variables, not in code
